By accessing or using Fynnally (“the Service”) at fynnally.com, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service. These Terms apply to all users, including free and paid subscribers.

2. Description of Service

Fynnally is a personal financial optimization tool. The Service allows you to input your financial data — including income, bills, debts, and goals — and receive AI-generated recommendations for managing your money.

Fynnally provides financial education and optimization tools, not licensed financial advice. The AI assistant (“Fynn”) generates recommendations based on your data and general financial principles. These recommendations are for educational and informational purposes only and do not constitute personalized investment advice, tax advice, legal advice, or any other professional financial advisory service.

Fynnally is not a registered investment advisor, broker-dealer, financial planner, or fiduciary. We strongly recommend consulting a licensed financial professional for decisions involving significant sums of money, investments, taxes, or complex financial situations.

3. User Accounts

• You must be at least 18 years old to use Fynnally
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activity that occurs under your account
• You agree to notify us immediately at support@fynnally.com if you suspect unauthorized access to your account
• You may only maintain one active account. Creating multiple accounts to circumvent free-tier limits is prohibited
• You agree to provide accurate information when creating your account and using the Service

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to any part of the Service or its infrastructure
• Use automated scripts, bots, or scrapers to access the Service or extract data
• Share your account credentials with other users
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Use the Service to collect or store personal data about other users
• Interfere with or disrupt the Service or servers connected to the Service
• Use the Service to transmit any harmful, offensive, or abusive content

The information provided by Fynnally and Fynn is for educational and informational purposes only. It does not constitute financial, investment, tax, or legal advice. Fynnally is not responsible for any financial decisions you make based on the Service's recommendations.

Financial circumstances vary widely between individuals. Fynn's recommendations are generated algorithmically based on the data you provide and may not account for your complete financial picture, tax situation, local laws, or personal circumstances. Always exercise your own judgment and consult qualified professionals for significant financial decisions.

7. Intellectual Property

The Service, including its design, code, content, and branding, is owned by Fynnally and protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Service without our express written permission.

You retain ownership of the financial data you input into the Service. By using the Service, you grant us a limited license to use your data solely to provide the Service to you.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Fynnally and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to financial losses, arising from your use of or inability to use the Service, or from any financial decisions made based on Fynn's recommendations.

Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

9. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

10. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for violations of these Terms, fraudulent activity, or any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately.

You may terminate your account at any time by contacting support@fynnally.com. Upon termination, we will delete your data within 30 days as described in our Privacy Policy.

11. Governing Law

These Terms are governed by the laws of the State of New York, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of New York.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or via an in-app notice at least 14 days before they take effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
